Terms of Sale

Last Updated: February 19, 2026

These Terms of Sale apply to all purchases made from Realistic Design NYC LLC (“RD NYC”).

1. Custom Products; Final Sale

All window treatments sold by RD NYC are custom-made to the Client’s specifications.

All sales are final. All payments are non-refundable. No returns, exchanges, credits, or refunds will be permitted under any circumstances except as expressly provided in Section 6 regarding confirmed manufacturing defects.

The Client is solely responsible for the selection of product type, style, color, controls, mounting method, and installation option.

2. Three-Day Right to Cancel

Client may cancel the sale without penalty until midnight of the third business day after payment is made by providing written notice of cancellation.

After this three-day period, RD NYC will place the order with the manufacturer. Once the order is placed with the manufacturer, no changes, cancellations, credits, or refunds will be accepted.

3. Pricing; Payment

All prices are as stated at the time of checkout. Payment in full is required before an order is submitted to the manufacturer.

RD NYC reserves the right to correct pricing errors, typographical errors, or system miscalculations prior to submitting the order to the manufacturer.

4. Lead Times; Delivery Estimates

All products sold by RD NYC are manufactured in Europe and routed through North America prior to final delivery.

Typical lead times are approximately six to eight weeks from order placement but may vary depending on manufacturer production schedules, international freight conditions, customs processing, seasonal factory closures, supply chain disruptions, and other global logistics variables.

All lead times are estimates only and are not guaranteed. RD NYC is not responsible for delays or for any consequential damages arising from such delays.

Clients will be notified if estimated delivery timelines change materially.

5. Shipping; Risk of Loss

Risk of loss transfers to the Client upon delivery.

The Client is responsible for inspecting all products immediately upon receipt. Any claim for shipping damage must be reported in writing to RD NYC within five (5) business days of delivery and must include clear photographic documentation.

Failure to report shipping damage within this period constitutes acceptance of the shipment.

6. Warranty; Manufacturer Remedy Only; Definition of Defect

All products are covered solely by the manufacturer’s warranty, if any.

RD NYC will assist in good faith with warranty claims but does not provide independent warranties and expressly disclaims all express or implied warranties.

A “manufacturing defect” means a material defect in materials or workmanship that causes the blind to fail to operate as intended under normal use in accordance with the manufacturer’s specifications.

Variations in color, tone, or texture; differences between website images and actual product appearance; screen-to-screen color variation; customer dissatisfaction with color selection; minor dimensional tolerances within industry standards; slight fabric puckering; light gaps; normal operational characteristics; projection beyond the glazing bead as described in Section 9; damage caused by improper installation, handling, or use; damage to windows, glass, frames, or surrounding finishes; and issues arising from customer-provided measurements do not constitute manufacturing defects and are not grounds for repair, replacement, refund, or claim.

The sole and exclusive remedy for a confirmed manufacturing defect shall be repair or replacement of the defective blind, at the manufacturer’s discretion. Under no circumstances shall RD NYC be obligated to issue a refund.

Determination of whether a manufacturing defect exists shall be made in accordance with the manufacturer’s standards and inspection procedures.

Claims of manufacturing defect must be submitted in writing within five (5) business days of delivery and must include clear photographic documentation sufficient to evaluate the claim. Failure to timely report a claimed defect constitutes acceptance of the product.

7. Installation; No Window Damage Liability

RD NYC does not install products.

The Client may self-install, hire an installer of their choosing, or use an installer recommended by RD NYC. In all cases, RD NYC is not responsible or liable for installation or for damage to windows, glass, frames, seals, surrounding finishes, or products arising from installation.

The Client is advised to confirm window integrity prior to installation. Installing blinds too close to the windowpane may increase the risk of glass breakage.

A slight light gap around the perimeter of blinds is expected and is not a defect.

8. Client-Provided Measurements

When Clients provide their own measurements, RD NYC processes orders using those measurements and is not responsible for sizing errors unrelated to manufacturing defects.

Clients assume full responsibility for costs associated with incorrect measurements.

9. Narrow Glazing Bead; Projection Acknowledgment

The top-down/bottom-up tilt and turn window shade model has an approximate blind depth of one inch (1"). Certain installation methods may use brackets that occupy approximately one inch (1") or up to one and one-half inches (1 1/2") of glazing bead depth, depending on the selected mounting option.

When installed between the glazing bead using drill-in footplates or adhesive strip brackets, the blind may not sit fully recessed within the inner glazing bead. Depending on bead depth and installation conditions, the blind may project beyond the face of the bead.

By placing an order for a between-the-bead drill-in or adhesive strip installation option, the Client acknowledges and assumes the risk that the glazing bead depth may result in visible projection of the blind beyond the glazing bead and agrees that such projection is an expected installation outcome and is not grounds for return, refund, exchange, or warranty claim.

10. Limitation of Liability

To the maximum extent permitted by law, RD NYC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to any product purchase, including but not limited to property damage, glass breakage, loss of use, lost profits, delay, or third-party installation costs.

RD NYC’s total liability for any claim shall not exceed the purchase price paid for the specific individual blind that directly gives rise to the claim, and in no event shall liability extend to any other products included in the same order.

11. Force Majeure

RD NYC shall not be liable for delays or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, international shipping delays, customs holds, labor disruptions, governmental actions, pandemics, manufacturer shutdowns, supply chain interruptions, or transportation failures.

12. Governing Law; Entire Agreement

These Terms of Sale are governed by and construed in accordance with the laws of the State of New York, without regard to principles of conflict of laws.

The order confirmation, receipt, or invoice generated through the online checkout process, together with these Terms of Sale and any policies expressly incorporated by reference, constitute the entire agreement between the parties with respect to the online purchase and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral.

Any dispute arising out of a purchase shall be resolved in accordance with the dispute resolution provisions set forth in the Terms of Use.
